Location
The property comprises five enclosures of arable land situated in the parishes of Burwell and Swaffham Prior. The land is principally located to the south and west of the village of Burwell which lies approximately 8 kilometres (5 miles) north west of Newmarket and 20 kilometres (12 miles) north east of Cambridge.
Description
The land is divided into five separate enclosures extending to 28.58 Hectares (70.51 acres) in all. The land is principally classified as Grade 2 with one field being classified as Grade1 and all of the fields are suitable for a range of arable crops. The land is predominantly flat and situated between 5 and 15 metres above sea level. All of the fields are regular in shape and suitable for working with modern farm machinery. Access to the land is either directly off the public highway or via droves. The individual lots are as follows:
Lot 1
Lot 1 comprises a single enclosure extending to 6.56 hectares (16.20 acres) accessed via a hard surface track from the public highway. The land is classified as Grade 2 and the Soil Survey of England and Wales classifies the soils as being of the Peacock series, suitable for growing winter cereals with beans or oilseed rape as occasional break crops and sugar beet and potatoes.
Lot 1 is located off Whiteway Drove approximately 2.5 kilometres north west of Swaffham Prior. To access the field from Swaffham Prior, take Station Road which becomes Whiteway Drove. Turn Left and go past Slades Farm and then bare left past a footbridge and follow the track until you see a metal gate on your left.
Lot 2
Lot 2 comprises a single enclosure extending to 4.28 hectares (10.57 acres) with good access from the Newnham Drove. The land is classified as Grade 1 and the Soil Survey of England and Wales classifies the soils as being of the Peacock series, suitable for growing winter cereals with beans or oilseed rape as occasional break crops and sugar beet and potatoes.
Lot 2 is located off Newnham Drove approximately 2 kilometres north west of Burwell. To access the field from Burwell, take Reach Road and then turn right onto Weirs Drove and take the second left onto Newnham Drove. The field is 1.5 kilometres along Newnham Drove on the left hand side.
Lot 3
Lot 3 comprises a single enclosure extending to 6.06 hectares (14.97 acres) with good access from Hightown Drove. The land is classified as Grade 2 and the Soil Survey of England and Wales classifies the soils as being of the Reach series, suitable for growing cereals, sugar beet and potatoes.
Lot 3 is located off Hightown Drove 2 kilometres west of Burwell. To access the field from Burwell take the Reach Road and then turn right onto Weirs Drove and take the first left onto Hightown Drove and the field is 0.6 kilometres along Hightown Drove on the left hand side.
Lot 4
Lot 4 comprises a single enclosure extending to 5.97 hectares (14.75 acres) accessed via a hard surface track from the B1102. The land is classified as Grade 2 and the Soil Survey of England and Wales classifies the soils as being of the Wantage 2 series, suitable for growing winter cereals, beans, peas and spring barley.
Lot 4 is located off Swaffham Road on the southern edge of Burwell. To access the field follow Swaffham Road towards Swaffham Prior. Just before the end of the village, there is a track between two houses on the left-hand side of the road immediately after 31 Swaffham Road. Follow this track and the field is on the right hand side.
Lot 5
Lot 5 comprises a single enclosure extending to 5.71 hectares (14.12 acres) accessed via a track from Heath Road. The land is classified as Grade 2 and the Soil Survey of England and Wales classifies the soils as being of the Swaffham Prior series, suitable for growing winter and spring cereals, sugar beet, potatoes, peas and beans.
Lot 5 is located off Heath Road on the southern edge of Burwell. To access the field from Burwell turn left off the High Street onto Heath Road. The access track is 0.5 kilometres along Heath Road on the left hand side with a metal gate across the access track.
Development Overage
Lot 4 will be sold subject to an Overage Agreement reserving 50% of any increase in value of the land attributable to the grant of any planning permission for any development other than for agricultural or equestrian purposes for a period of 25 years from the date of completion.
Entry and Holdover
The land is not currently cropped and the purchaser will be take possession on completion.
Basic Payment Scheme
The Basic Payment Scheme entitlements are included in the sale of the freehold. The vendor will retain the BPS income for the 2022 scheme year and the purchaser(s) will be required to indemnify the claimant with regard to any claim in respect of breach of cross compliance or any other relevant scheme regulations for the current year up until 31 December 2022.
Environmental Schemes
The land is not subject to any agri-environmental schemes.
Drainage Rates
Drainage rates are payable on Lots 1, 2 and 3 to the Swaffham Internal Drainage Board. The drainage rates for the 2022/23 year will be apportioned on completion.
Sporting, Timber and Minerals
All sporting, timber and mineral rights are included in the sale insofar as they are owned.
Wayleaves, Easements, Covenants and Rights of Way
There is an easement for a high pressure gas main which crosses Lot 5.
The land is sold subject to and with the benefit of all existing wayleaves, easements, covenants and rights of way whether or not disclosed.
VAT
The land is not registered for VAT. However, if the sale of the property or any right attached to it is deemed a chargeable supply for the purpose of VAT, such tax shall be payable by the purchaser in addition to the sale price.
